Child maintenance in Kenya is governed primarily by the Children Act, 2022 (and related family law frameworks), which places paramount importance on the welfare of the child and the duty of parents to provide maintenance.
Spousal maintenance may arise from court orders under the Marriage Act, 2014, divorce decrees, or binding separation agreements. Enforcement typically requires showing the obligation, the arrears, and that the paying party has capacity to pay.
