Demand Letter for Child Support/Maintenance

Coming soon: enforce child support or maintenance payments with a formal demand from a registered Kenyan advocate.

Planned pricing: KES 4,500 when live

What this demand letter covers

A child support or maintenance demand letter formally documents arrears owed under a court order, separation agreement, or other binding maintenance obligation — and gives the paying party a clear deadline before further enforcement.

Maintenance disputes are sensitive and fact-specific. A letter on advocate letterhead sets out the amount in arrears, the basis of the obligation, and the consequences of non-payment without the hostility of an immediate court application.

Noticus is adding child support and maintenance letters soon. Use the information below to understand the process, and join the waitlist to be notified when intake opens.

What Kenyan law says

Statute references on this page are general guidance. Citations for this use case are not yet verified in Noticus letter-drafting — please review with your advocate before relying on them in a live letter.

Child maintenance in Kenya is governed primarily by the Children Act, 2022 (and related family law frameworks), which places paramount importance on the welfare of the child and the duty of parents to provide maintenance.

Spousal maintenance may arise from court orders under the Marriage Act, 2014, divorce decrees, or binding separation agreements. Enforcement typically requires showing the obligation, the arrears, and that the paying party has capacity to pay.

⚠️ Statute citations for family law maintenance letters are not yet verified in Noticus letter-drafting prompts — please review with your advocate, especially where court orders or consent agreements must be quoted accurately.

Cost and timeline

When live on Noticus, child support and maintenance demand letters are planned at KES 4,500 with standard processing in 3–5 business days. Complex cases involving contested orders may need additional legal advice beyond a standard demand letter.

What happens if they ignore the letter?

If the paying party ignores the letter, you may apply to the court that issued the maintenance order for enforcement, attachment of earnings, or committal for contempt in serious cases. The demand letter creates a paper trail showing you gave notice before escalating. Time limits and enforcement tools depend on your specific order — seek advice if arrears are substantial.

Frequently asked questions

When will child support and maintenance letters launch on Noticus?
This service is coming soon. Join the waitlist on this page. Until intake opens, the content here is for information only — you cannot yet create a letter through Noticus for this use case.
Do I need a court order before sending a maintenance demand?
A demand letter is strongest when backed by a court order, registered agreement, or clear written obligation. If you only have an informal verbal promise, outcomes are less certain. Upload your order or agreement when intake opens so the advocate can reference it.
Can this letter enforce child support arrears?
When live, the letter will formally demand payment of documented arrears and set a deadline. It does not itself enforce payment — but it is a recognised step before returning to court for enforcement remedies.
Does this cover spousal maintenance as well as child support?
Yes. When the service launches, it will cover both child maintenance and spousal maintenance arrears where a legal obligation exists.
Is the letter legally binding on the other parent?
A demand letter is formal notice, not a new court order. It puts the paying party on clear legal notice of arrears and your intent to escalate. Binding enforcement still flows from the underlying court order or agreement.
